Distributing your bits

Distributing your bits: If you create a digital experience, does everyone else have a right to share it? That's a difficult question, and I don't think we've found consensus yet. Here, Andrew Scudder describes on Lessig Blog the "everyone must have your bits" position, in reaction to a friend who wanted to display her photos online but not in print. I can see his position, but I can see hers too. More and more I'm wondering whether the key issue in this conversation is actually prior abusive use of copyright and its potential for the future, rather than the ability of individuals to control the data (whether text or media) they produce -- the bad use rather than the bad tool. There's got to be a way to reconcile these two sets of needs....
