Trademark problems

Trademark problems: Last month there was some controversy around a name-change request, but this article at InteractiveTV Today shows, I think, why such care is necessary. It starts: "At the NAB show in Las Vegas last month, thePlatform, a provider of digital video publishing solutions, unveiled a tool, dubbed MPS Flash Portals, which it says will allow content providers to publish their broadband video into a 'Flash-based experience' that supports advertising and syndication." There's a mention of Adobe towards the end, when they get into their serverside video encoding, but it's hard to tell exactly what they mean with all this "flash". These risks are now particularly strong in the video and mobile worlds, where the business demands for Flash Platform technologies increased rapidly once the Adobe name was added in front -- dilution risks go beyond the browser now. This particular incident hasn't seemed to spread very far -- doesn't seem to be much real info on their site, either -- but I hope this shows more clearly the types of ambiguities we're trying to resolve these days.

Just out of curiosity, this SWFObject (formerly FlashObject) flash player detector, is this currently the best way to detect the current player? It looks really well thought out, it seems maybe the trademark aspect of the story is overshadowing a technical aspect that could be useful.
